Object
These General Terms and Conditions of Sale (hereinafter: GTC) govern the rights and obligations of the parties in the context of online sales via the website www.jaimeconcept.ch offered by Jaime Sàrl, whose registered office is at Rue des Boudines 3, 1217 Meyrin, Switzerland (hereinafter referred to as the seller).
Buyer's address
Only buyers domiciled in Switzerland may order products from the online shop.
Buy
Any order placed in the online shop (hereinafter referred to as a purchase) implies unreserved acceptance of these GTC by the purchaser.
Products : flowers & floral arrangements
The images and descriptions published on the seller's website are provided for information purposes only. Given that the entire choice of flowers is not necessarily available on a daily basis, the seller reserves the right to modify the floral arrangement according to its available stock. The seller endeavours to respect the buyer's choice as closely as possible to the likeness of the floral arrangement in the photo chosen by the buyer. No claims will be accepted in the event of a change in the choice of flowers based on availability.
Products : gifts and home decoration
The images and descriptions of the products published on the seller's website are provided by the seller's suppliers. These data are useful for the potential buyer to obtain information before confirming the purchase.
Confirmation
All successfully completed purchases are subject to a purchase confirmation message and an e-mail confirming receipt of the purchase. If no order confirmation is received, the buyer should contact the seller directly on +41 22 980 09 09.
Buy
The sales contract is deemed to have been concluded when the purchase is confirmed. However, Jaime Sàrl reserves the right to cancel the contract at any time, particularly in the event of stock being exhausted. The price paid by the buyer will be refunded to the exclusion of any other compensation or damages.
Data relating to the delivery of flowers
When placing an order, the purchaser attests to the truthfulness and accuracy of the information provided. The information communicated by the purchaser must be correct, complete and sufficient to enable the order to be properly executed and delivered. In the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of carrying out the delivery correctly.
Absence of the recipient when flowers are delivered
If the recipient is absent at the time of delivery, the delivery person will make every effort to contact the recipient on the telephone number given by the purchaser when the order was placed. If there is no response, the delivery person will try to find the best solution to allow the delivery to be completed in the best possible conditions (neighbour, caretaker, doorstep). The buyer expressly accepts this procedure. If delivery is not possible, the goods will be returned to the seller, who will make them available for collection by the buyer. An electronic message will inform the buyer of the place and time of collection.
Delay in flower delivery
In the event of a delay in delivery of more than 12 hours from the end of the time slot requested by the buyer, a request for reimbursement of the full amount of the order may be made, to the exclusion of any other damages or compensation. If the reason for the delay is attributable to the buyer, no claim may be made.
Complaints following a flower delivery
If the purchaser is not entirely satisfied with the quality of the service provided, he or she must submit a complaint within two days of the date of delivery by e-mail to info@jaimeconcept.ch adding any evidence to substantiate the claim (e.g. photos, etc).
Prices
Prices are given in Swiss francs (CHF), including VAT. Delivery costs are added to the basket price. The seller reserves the right to change prices at any time.
Delivery (excluding flowers)
During the week, orders placed before noon will be dispatched the same day. Orders placed after midday will be dispatched the following day. Deliveries are made by «La Poste» using PostPac Priority (delivery on the next working day).
Payment
Payment is possible by : Credit cards (VISA, Mastercard) and Twint.
Exchanges, returns and cancellations (excluding flowers)
If a product is not to the purchaser's liking, they have a period of 10 days from receipt of their order to notify their right of withdrawal. This objection must be made in writing (by email or post). The seller must confirm that it has received the objection before the buyer returns the goods to the seller in perfect condition and in their original packaging. The returns address is as follows: Jaime Sàrl, Rue des Boudines 3, 1217 Meyrin (Switzerland).
The cost of returning the goods shall be borne by the purchaser.
If the buyer finds a defect in a product received, he/she has 48 hours from receipt of the order to notify the seller. Any complaint will only be accepted by e-mail sent to info@jaimeconcept.ch.
Floral workshops cancellation policy
Floral workshops take place with a minimum of 3 participants. Failing this, the workshop will be postponed until the minimum number of participants has been reached.
If you wish to cancel your registration, please send us an e-mail at least 5 days before the date of the workshop to info@jaimeconcept.ch in order to obtain a refund. If this is not the case, no refund can be requested and/or made. Jaime Sàrl reserves the right to cancel the order at any time, in which case the price paid by the buyer will be refunded, to the exclusion of any other compensation or damages.
Account management
When creating his/her account, the buyer confirms that he/she is of legal age and responsible. They also confirm that their personal details are accurate. The buyer is solely responsible for access to his/her account. The seller cannot be held responsible for fraudulent operations carried out by third parties.
Data protection
Subject to the provisions of these GTC to the contrary, the seller acknowledges the confidentiality of the information provided by the buyer when the order is placed and undertakes not to divulge this information to third parties.
The buyer has the right to access and rectify any personal data concerning him/her. To exercise this right, the buyer should contact the seller, providing proof of identity.
For the rest, the provisions of the «Confidentiality and data protection policy» form apply.
Force majeure
The seller may not be held liable if the non-performance or delay in performance of one of its obligations is due to force majeure.
Intellectual property
Any reproduction and/or total or partial representation of elements belonging to the seller (website, photos, logo, etc.) is prohibited.
Amendments to the GTC
The seller may amend these GTC at any time. The version in force at the time the order is placed shall prevail in the contractual relationship between the buyer and the seller.
Applicable law and place of jurisdiction
In the event of a dispute, the GTC in force at the time of purchase shall be used as the legal basis. These GTC are governed by Swiss law, in particular by Articles 184 et seq. of the Swiss Code of Obligations, to the exclusion of any other foreign legislation.
The place of jurisdiction is Geneva, Switzerland.
